What Tourists Should Know About Marijuana in Fort Myers

Florida has no recreational (adult-use) cannabis. Possessing marijuana without being a qualified Florida medical patient is illegal statewide. Under Florida law, possession of 20 grams or less can be charged as a first-degree misdemeanor; more than 20 grams is a felony.

Florida’s medical program is limited to Florida patients only. The state does not honor out-of-state medical marijuana cards; visiting patients must qualify as Florida residents (including certain “seasonal” residents) and obtain a Florida medical marijuana card before purchasing. Sales occur only through licensed Medical Marijuana Treatment Centers (MMTCs).

For qualified Florida patients, product and dosing limits are tightly regulated. MMTCs may dispense no more than a 35-day supply of smokable cannabis, capped at 2.5 ounces per 35 days (with limited exception procedures), and the Department of Health sets THC limits for non-smokable forms.

Where consumption is allowed: private spaces only. Even medical patients may not smoke or vape in public places, on any form of public transportation, on school grounds, or in most workplaces. Property owners (including hotels and vacation rentals) may restrict cannabis use on their premises.

Driving: Drug-impaired driving is illegal. Florida’s DUI statute applies to cannabis; operating a vehicle while your “normal faculties are impaired” by a controlled substance can result in arrest and the same penalties as alcohol DUIs. The state highway safety department reinforces this: drive baked, get busted. Plan a sober ride.

Air travel and airports: Cannabis remains illegal under federal law. TSA guidance states marijuana and many cannabis-infused products are prohibited; officers refer suspected violations to law enforcement. Hemp products with ≤0.3% delta-9 THC (by dry weight) are federally permissible, but labeling must match and rules can be inconsistently enforced. If you’re flying into or out of Southwest Florida International (RSW), don’t attempt to travel with state-legal marijuana.

Hemp and “delta-8/delta-9” drinks: Florida has been actively debating tighter controls on intoxicating hemp products. As of mid-2025, lawmakers advanced bills to cap potency and ban certain synthetics, while previous broader restrictions were vetoed in 2024. Expect rules to change and check labels carefully—“hemp” does not equal “OK to use anywhere.”

Bottom line for Fort Myers visitors:

  • There are no legal recreational dispensaries.
  • Only Florida-registered patients can buy from MMTCs, subject to strict limits.
  • Public consumption is prohibited; keep any lawful use private.
  • Never drive impaired and don’t fly with marijuana.
